Bank reimbursement rules: what the UK victims can claim

2024 was the year reimbursement duties hardened: banks in the UK face explicit obligations when their customers are defrauded, provided the claim is filed properly. Most victims still never file correctly.

What the rules actually require

Under the APP-scams reimbursement rules, a bank must handle fraud claims promptly, act on warnings and, in defined circumstances, reimburse. The victim's job is to fit the facts into those duties with documents.

A claim that simply says "I was scammed" fails. A claim that shows the payment, the deception, the platform's illegal status and any the FCA warning succeeds far more often.

The crypto complication

Banks sometimes refuse crypto-fraud claims as "investment losses". The rebuttal: the fraud was the misrepresentation, and the payment leg — through Faster Payments — is exactly what reimbursement rules cover.

UK victims should also check the FCA Register before transferring, and remember that banks must offer a claim under the APP reimbursement rules even when the payment was made voluntarily.

Filing a claim that gets paid

Structure it: what was promised, what was paid, when the deception became clear, what the bank did or failed to do. Attach the Action Fraud report number and any regulator warning.

If the bank rejects, escalation routes exist — ombudsman or dispute schemes. Rejection on first pass is common; persistence with documents changes outcomes.

Frequently asked questions

How long do I have to file a reimbursement claim?

Promptly — many schemes expect claims within months, not years. File now even if evidence is incomplete; you can add to it.

The bank says crypto losses are not covered. Is that final?

No. That is a position, not a ruling. Escalate with the deception documented — complaint bodies reverse a meaningful share of these refusals.
